Yes, New York sports betting is legal. You can bet online from anywhere in the state and in person at NY casinos. Online sports betting sites launched in January 2022, and currently, eight sportsbook apps are available in the state.

NY sports betting law
Legal sports betting in New York is available online and in person at a handful of upstate casinos. The casinos offering retail sportsbooks in NY are located a few hours’ drive from New York City. That makes them an inconvenient and impractical option for the bulk of the state’s population.
In fact, before online sports betting became legal in the state, many New York City-area sports bettors who wanted to get legal action down would travel to neighboring New Jersey. The 2021 law changed that, however. The law was part of an overall budget package and signed by Gov. Andrew Cuomo in April 2021.
The New York State Gaming Commission accepted two bids for online sports betting in the Empire State in November 2021. Those two bids came from two groups of sportsbooks that allied with one another to present a more appetizing case to the commissioners. As a result, nine books received the all-clear to launch online sports betting in New York, each agreeing to pay 51% of their revenues to the state in taxes. The sportsbook apps officially went live on Jan. 8, 2022, with four apps at the start. Eventually, nine sites were live, although one has since shut down, bringing the current total to eight.
In October 2023, New York regulators voted to adopt new rules that would make “explicit that [fantasy] contests shall not be based on proposition betting or contests that have the effect of mimicking proposition betting.”

NY sports betting bills
We should be done with new NY sports betting bills for a bit after state legislators, and Cuomo included mobile sports betting in the New York state budget in 2021.
- 2026: Three bills were proposed. One would ban all in-play betting. Another would eliminate prop bets, leaving only final-score wagers. Neither of those passed. A third, requiring monthly bettor statements, passed both chambers unanimously and was sent to the governor’s desk, but it has not yet been signed into law.
- 2025: A bill to expand licenses to 16 and cut the 51% tax rate stalled in committee. Another proposal was introduced that would add a $5,000 daily wagering cap and an ad blackout during games. The Fair Play Act would bar sportsbooks from limiting winning bettors, alongside a companion bill that would default bettors to wagering limits. A separate proposal targeted Kalshi, Polymarket, and other prediction markets offering sports contracts in the state. The first stalled in committee, while the latter made it out of committee but never reached a floor vote.
- 2023: A bill to restrict “predatory” sportsbook bonus offers as deposit matches and profit boosts stalled in committee.
- 2021: No separate bill was necessary to introduce, because legislators included sports betting in the massive state budget bill. Cuomo signed sports wagering into law as part of that package.
- 2020: An effort to reintroduce bills from 2019 stalled out because of the COVID-19 pandemic. New York legislators delayed their session and took up more pressing matters upon their return.
- 2019: A mobile sports betting bill advanced past the NY Senate, but never came up for a vote in the Assembly.
- 2018: NY mobile sportsbook bills popped up in both chambers of the state legislature. However, neither the Assembly nor the Senate chose to move the bills past the committee stage.
Where can I bet on sports in New York?
Online sportsbooks are available from anywhere in the state, meaning you can wager as long as you are located in New York. Geolocation software will verify your location when you attempt to wager.
You can also bet in person at 11 retail sportsbooks, which began opening at casinos in the state in 2019. NY online casinos are not yet legal. A 2013 law permits NY sports betting at commercial casinos in the state and, in turn, tribal casinos. As such, 11 of the roughly two dozen gambling locations in the state have an on-site sportsbook.

How does New York compare to New Jersey and Pennsylvania?
The NJ sports betting market is closely linked to New York City. Some estimates suggest that 25% of New Jersey handle originates from the country’s largest city.
New Jersey features more than a dozen sportsbooks, while New York is limited to nine. The Garden State also levies a tax rate of 13.5% on mobile sports wagers, while New York will require books to remit 51% of sports betting revenue to the state.
Pennsylvania features one of the highest tax rates and sportsbook license fees in the country, but New York eclipses both. NY sportsbooks must pay a $25 million application fee, surpassing the previous US high of $20 million in PA.
Pennsylvania features one online sportsbook per casino, allowing the state to offer many more options than will be available in New York.

2026: The monthly New York sports betting handle continued to climb, reaching a new milestone in April by going over the $2 billion mark.
2025: Resorts World Bet Sportsbook exited the New York market on June 30, reducing the number of sites to eight. A bill to expand the operator pool and lower the country’s highest sports betting tax rate stalled in the legislature, leaving the 51% rate in place.
2024: Penn Entertainment purchased WynnBET’s sports betting license in New York and launched ESPN Bet Sportsbook in September 2024 for the NFL season. Meanwhile, Fanatics Sportsbook took over PointsBet’s license in NY and launched as well. In other news, bet365 partnered with 1/ST Technology to release a new horse betting app, 1/ST Bet. Also, New York Sen. Joe Addabbo introduced S9044, a bill to raise the legal age to participate in fantasy sports contests from 18 to 21, but it failed to advance.
2023: After a good year in 2022 that saw New York become one of the top legal sports betting markets nationwide, the industry exploded in 2023. July was the only month in which sports betting handle in the state was below $1 billion, and the handle exceeded $2 billion in October, November, and December. By the end of the year, New York had climbed third in the all-time list for sports betting handle nationwide, and the state had collected the most taxes (more than $1.5 billion) of any state.
2022: The new online market in New York took off on Jan. 8 with four online sportsbooks receiving approval to launch. Caesars, DraftKings, FanDuel, and BetRivers all went live, just in time for the NFL playoffs. The other five online books arrive in spurts over the following weeks, with BetMGM and PointsBet the first to join the fast-growing market. By February, WynnBET had launched as well, bringing the number of sports betting apps to seven.
In its first 16 days, New York online sports betting handle eclipsed $1 billion, quickly making NY the biggest legal betting market in the US. Resorts World Bet and Bally Bet would also join later in the year, bringing the total to 9 NY online sportsbooks.
2021: The most promising year to date for NY online sports betting began with Gov. Andrew Cuomo signaling his willingness to include mobile wagering in his state budget. A deal in April 2021 paved the way for mobile betting in New York. The initial bidding process culminated in the state ultimately choosing nine sportsbook operators from two super bids.
2019: Sen. Joseph Addabbo, the new chairman of the Senate Racing, Wagering and Gaming Committee, introduced a sports betting bill for the 2019 legislative session. The bill, S 17, was similar to former chairman John Bonacic’s bill and included a 0.2% integrity fee. While the bill passed the Senate, it never came up for a vote in the Assembly.
2018: New York state legislators offered sports betting bills in the Assembly and Senate, but neither advanced to the floor for serious consideration. Then, in January, the Senate Racing, Gaming, and Wagering Committee held a public hearing on sports betting. The hearing indicates that New York’s lawmakers are ready to move forward with broad legalization.
2015-16: A 3080 and S 940 were refiled in January 2015. The sports betting bills were returned to the Judiciary Committees in their respective chambers, where they stalled once more. Meanwhile, the state considered legislation on daily fantasy sports. The matter was referred to Attorney General Eric Schneiderman, who lumped DFS in with sports betting in a way that would have made fantasy sports illegal under state law, and he ordered DraftKings and FanDuel to cease operations in New York. However, the state passed a fantasy sports law in 2016.
2013-14: Sen. Eric Adams once again reintroduced his standalone sports betting bill from the prior sessions. His S 2411 was the same piece of legislation he sponsored in both 2009 and 2011. A 867 and S 331 were also reintroduced. All failed to advance out of committee again.
2011-12: Adams reintroduced a copy of his previous bill in 2011. This time, S 3708 was backed up by another piece of legislation in the lower chamber. Two more bills appeared as well, A 10464 in the House and S 7401 in the Senate, but none of these advanced.
2009-10: In 2009, Adams introduced the state’s first sports betting bill. S 6061 was aimed at horse tracks and off-track betting facilities, but it stalled in committee.
