West Flagler Associates, which owns Casino Miami and Bonita Springs Poker Room, mounted a legal challenge. US District Judge Dabney Friedrich upheld the appeal, ruling that the compact violated the Florida constitution and the federal Indian Gaming Regulatory Act. The tribe was forced to take the sportsbook offline after just 34 days.
A two-year legal battle ensued. In June 2023, the US Circuit Court of Appeals reversed Judge Friedrich’s 2021 decision. WFA appealed again, but the Florida Supreme Court rejected its request. That paved the way for the Seminole Tribe to relaunch Hard Rock Bet in November 2023. The US Supreme Court has also declined to take up an appeal from WFA, cementing the Seminole Tribe’s right to offer online sports betting in Florida.
The next step would be to launch a real money online casino. The Seminole Tribe offers online casino gaming in New Jersey under the Hard Rock brand, so it has the software in place. An updated tribal-state gaming compact would be necessary before the Seminoles could launch a casino app, but that is a distinct possibility. Seminole Gaming CEO Jim Allen has even suggested that the tribe may be prepared to give up its exclusive rights to run online Florida sports betting if it received permission to launch a casino app.
