Is Underdog Fantasy legal?

Underdog Fantasy operates in a gray area of the law, with significant questions about whether some of its products are actually sports wagering. While fantasy sports operate under a specific carveout of the Unlawful Internet Gaming Enforcement Act, the legality of Underdog Fantasy is in question in multiple states.

The UIGEA took effect in 2006, before any form of daily fantasy sports existed. The carveout was intended for season-long fantasy games, which means the act never contemplated allowing what are essentially prop bet parlays not regulated by the same rules that cover sports betting. 

Currently, nine states and the province of Ontario do not allow Underdog to operate its fantasy drafts in their jurisdictions. The fantasy pick’em product, meanwhile, is banned from an additional 10 states, nine of which offer legal sports betting. That suggests there is no clear consensus on whether these parlay-style props are legal fantasy games or not.
